Terms And Conditions
Introduction
This Master User Agreement constitutes a binding contract between you, the User, and Gammie and Co’s brand; VAGABOND EXPERIENCES/Vagabond with regard to the use of various services that are provided by VAGABOND EXPERIENCES/Vagabond.
- The services under this agreement shall be rendered by Gammie and Co, a firm duly constituted as a Partnership and having its registered office at A/6, Mulund Mira Niketan CHS, M.M.M. Road, Nahur Road, Mulund West, Mumbai, Mumbai Suburban, Maharashtra, 400080(hereinafter referred to as “Vagabond”).
- Vagabond shall provide you (“User”) event-related information, pricing of partner destinations, trip packages, and itineraries across the world (“Service”). This Service may be availed by the User in India at any time during the year as is offered by various third party vendors like homestays, partners etc. (“Service Providers”).
- This Master User Agreement (“Agreement”) is applicable to all Vagabond Services. In addition to this Agreement and depending on the Services opted for by the User, the User shall be required to read and accept the relevant terms and conditions of service (“TOS”) for each such Service, which may be updated or modified by Vagabond from time to time. Such TOS shall be deemed to be a part of this Agreement and in the event of a conflict between such TOS and this Agreement, the terms of this Agreement shall prevail.
- Vagabond Services are offered to the User conditioned on acceptance without modification of all the terms, conditions and notices contained in this Agreement and the TOS, as may be posted on the Website from time to time. For the removal of doubts, it is clarified that availing of the Services by the User constitutes an acknowledgement and acceptance by the User of this Agreement and the TOS. If the User does not agree with any part of such terms, conditions and notices, the User must not avail Vagabond’s Services.
- Additionally, the Service Provider itself may provide terms and guidelines that govern particular features, offers or the operating rules and policies applicable to each Service (for example, homestay reservations, itineraries, trip packages, etc.). The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of the Service Provider with whom the User elects to deal, including terms and conditions set forth in a Service Providers’ fare rules, contract of carriage or house rules.
- Vagabond at its sole discretion reserves the right not to accept any order placed by the user through the website without assigning any reason thereof. Any contract to provide any service by Vagabond is not complete until full money towards the service is received from the user and accepted by Vagabond.
- In case you have made a joint booking for yourself and other co-travellers, then it shall be deemed that each co-traveller who is part of your booking has also read, understood, and accepted these TOS.
- The service statements on this website are for general description purposes only. The information contained in this website should not be viewed as an offer to sell or as a solicitation to avail any of Vagabond’s services. Kindly note that the transportation service and accommodations including but not limited to trains, flights, bus, taxis, cruises ferries, hotels, and restaurants providing the services in the trip location are available for booking are not operated, supervised, or controlled in any manner by Vagabond. These services are provided by third party service providers that are entirely independent, and with whom you may be deemed to have separate contractual arrangements
- Vagabond may publish certain guidelines or additional TOS for each specific trip which would be in addition or supplemental to the TOS and will be deemed to be part of your contractual arrangement with Vagabond. Vagabond also reserves the right to amend, modify or replace the TOS or any guidelines or additional terms and conditions without any personal prior notice to you. You are therefore requested to keep yourself updated with the same.
- Vagabond’s website www.vagabondexperiences.com and services are offered only to residents of the Republic of India. In case you are from outside of the Republic of India then you shall be using Vagabond’s website and services at your own risk. You will be solely responsible for compliance with any applicable local laws of your jurisdiction.
How To Book
To reserve one of the partner destinations/itineraries/trips organised by Vagabond, you can make an online payment through our booking link or an email to contact@vagabondexperiences.com or call on +91 7400054929.
Payment
The prices quoted are for online payment, payment by bank transfer, online transfer or cheque. The total price is payable to Vagabond, 30 days prior to departure. Failure to pay by that date entitles Vagabond to cancel your reservations without notice. Prices are quoted in Indian Rupees.
All prices and details quoted on Vagabond’s website are to the best of our knowledge and constantly updated from time to time. Prices may be changed at the discretion of the partner destination or other service providers involved without prior notice, and Vagabond will not be held liable for such changes. In case of a conflict, the prices charged by the partner destinations and service providers involved will be final.
Cancellations
- If it becomes necessary to cancel your booking, you must notify Vagabond immediately by mail on contact@vagabondexperiences.com. Once we receive your notice, cancellation will take effect.
- Please refer to the trip details for the respective cancellation policies.
- If the event/tour/itinerary price is quoted as a package, no partial refunds or credit will be given for services not used. Please note that the quoted amounts may change without notice. We also recommend that you obtain travel insurance upon booking.
Refund Mode And Processing Duration
- Refund will be made using the same payment mode.
- Refund process will be initiated in 2 working days after cancellation.
- Refund amount will be credited in your account in 7 to 10 working days after process.
Health And Fitness Requirements
Participants must be in good health and reasonable physical condition. It is vital that participants with medical problems make them known to us well before departure. All medical expenses will be the responsibility of the participant.
Delay, Cancellation Or Change Of Itenerary
Vagabond reserves the right to cancel any booking in which case participants will be given a refund in full. However, you will not be entitled to make any further claim for any injury, loss, expenses or damage (either direct or consequential) or for any loss of time or inconvenience which may result from such cancellation (including but not limited to any travel reservation, visa, passport and vaccination charges, or departure, gear purchases, airport and airline taxes). We strongly recommend you book refundable tickets.
Insurance
Personal travel insurance is not included in the tour price. We strongly recommend that you get a travel insurance including cancellation insurance upon booking. Vagabond may require that a policy is held prior to departure. Vagabond will accept no liability for any damage, losses and expenses suffered by any client as a result of sickness, quarantine, weather conditions, war, strikes, riots or any other cause outside our control.
Route Changes/Postponement Or Delay
Vagabond will take every care to ensure that itineraries/trips are followed to the letter but circumstances beyond control may necessitate changes. In case of a change in routes and properties, Vagabond will accept no liability but make arrangements for substitution of equal.
Vagabond may for any reason change the date of departure or conclusion of the tour, or it is possible that a route change, postponement or delay (either in relation to departure or to the duration of the trip) may become necessary due to inclement weather, snow and ice conditions, political restrictions or any other cause. In the event of a change, postponement or delay, participants have no right to refund of the tour price (in whole or in part) or other compensation for any injury, loss or damage.
Package Prices
Package prices are based on destination costs, transport charges and exchange rates. Vagabond tries its utmost not to increase tour prices (in full or part), however sometimes increases are outside its control. We reserve the right to amend tour prices (or any part) without notice at any time before and including the departure date. Amendments may be necessitated for many reasons including, but not limited to, exchange rate fluctuations, increase in destination costs, transport charges, meals etc. Any increase in tour prices must be paid prior to the departure date.
Exclusions From Tour Price
The following items are excluded from the tour price:
Visa, passport, travel insurance and vaccination charges; departure, airport and airline taxes; extra meals not included in the itinerary; laundry, postage, telephone expenses, personal clothing, medical expenses, personal travel insurance and items of a personal nature; emergency evacuation charges; and tips and excess baggage charges.
Waiver Of Liability
I “the user” on availing Vagabond’s services, waive any and all claims I and/or my family or any person interested in me may now and in the future have against, and release from all liability and agree not to sue Vagabond and its management, officers, employees, guides, agents or representatives (collectively its staff) including but not limited to any persons hired/engaged by Vagabond for any personal injury, death, property damage, or loss sustained by me as a result of my participation in a trip with them, due to any cause whatsoever, including without any limitation, negligence on the part of Vagabond and its staff/service providers or otherwise arising out of or in connection with any accommodation, transportation or other services provided by Vagabond, or resulting directly or indirectly from acts of God, or breakdown in machinery or equipment used during the tour, whether provided by Vagabond or not. I am aware that the trip, in addition to the usual dangers and risks inherent, has certain additional dangers and risks, some of which may include: physical exertion for which I may not be prepared; weather extremes subject to sudden and unexpected change; remoteness from normal medical services; evacuation difficulties if I am disabled.
I understand that I should be in perfect health for undertaking this journey and have consulted my physician before coming on this trip.
I understand that Vagabond will not take responsibility for reimbursements in the event that I am unable to complete the trip due to sickness and/or other personal reasons.
I accept all the inherent risks of the proposed trip and the possibility of personal injury, death or property damage or loss resulting there from. I agree that if I suffer injury or illness, Vagabond, can, at my cost, arrange medical treatment and emergency evacuation service, as they deem essential for my safety. In entering into this Agreement, I am not relying on any oral, written or visual representations or statements by Vagabond or its staff or any other inducement or coercion to go on a trip, hence, only of my own free will. I confirm that I have read and understood the terms and conditions of contract and this Agreement and agree that this Agreement will be binding upon my heirs, next of kin, executors, administrators and successors.
Right Of Removal
Vagabond reserves the right to withdraw tour membership from anyone whose behavior is deemed likely to affect the smooth operation of the tour or adversely affect the enjoyment and personal safety of other participants. Vagabond shall be under no liability to any such person.
Data Policy, Photoghaphs And Videos
You agree that Vagabond may take your photographs or videos during the trip showcasing your experience. You consent to the usage or publication of your photographs and/or videos on the Vagabond website, any social networking websites, blogs, video hosting websites, or in any electronic or print media including but not limited to brochures, pamphlets, advertising material, promotional videos, etc. You expressly waive the condition of obtaining your prior consent to such usage or publication and / or asking for payment / remuneration in respect of such photographs and/or videos. You understand that all your credit cards/debit cards/ e-wallet or bank account related details will NOT be sold, shared, rented or leased by Vagabond to any third party. You consent to Vagabond sharing your credit cards / debit cards / e-wallet or bank account related details while contacting your bank or Vagabond’s bank or the payment gateway used by you for making payment for Vagabond’s services, for the purpose of confirmation of payments made by you. You expressly consent to Vagabond holding to your personal identifiable information which includes but is not limited to your name, age, address, photograph, copies of documents which act as a proof of identification or address(includes but is not limited to your copies of passport, PAN card, Aadhar card or driving license) and for the purpose of record and security for a period of twelve (12) months from the date of receipt. You expressly consent that Vagabond may store your contact information like mobile number/phone number/email address/social media profile link for marketing purposes for a period of twenty four (24) months from the date of receipt, which may be further extended by you. Vagabond shall store all your information in electronic equipments under its control. You consent to Vagabond contacting you for any promotional offers or marketing in the future, and you understand that this consent can be withdrawn by you at any point in time. Vagabond may from time to time, make your contact information and photographs available to associated entities or individuals, a list of which can be provided to you on request. your information that Vagabond holds including personal identifiable information or contact information or information in relation to your travel arrangements will not be disclosed to any third party unless required by law. Although Vagabond shall use its best endeavors to protect the storage of your personal information from any cyber attack or any attempt to illegally acquire your personal information, you agree that Vagabond shall not be held responsible in any manner for, the leak or theft of your personal information or any consequential damage or loss (whether direct or indirect) caused to you by such a leak or theft.
Applicable Law
This agreement / Booking form shall be interpreted and subject to the laws for the time being in force of the Republic of India. All disputes, suits or legal proceedings of any nature arising under the terms of this agreement/booking form shall be instituted within the territory of the Republic of India only.
In case you have made a joint booking for yourself and other co-travellers, then it shall be deemed that each co-traveller who is part of your booking has also read, understood, and accepted these TOS.
